Mediation

Mediation is a flexible and confidential process used to settle a dispute between two or more people, businesses or other organisations.

The mediation process is carried out by a mediator, a neutral person who acts impartially. Mediators do not side with either party but instead facilitate a discussion between the disputing parties to help them to settle on a mutually agreeable outcome. There is no set format for mediation, so it is up to the parties involved and the skill of the mediator.

Mediation can be used to resolve almost all types of civil dispute, including:-

  • professional negligence
  • personal injury
  • breach of contract
  • money disputes
  • bankruptcy
  • wills and probate disputes
  • trust disputes
  • charities disputes
  • guardianship disputes
  • land or property disputes
  • landlord and tenant disputes
  • neighbour disputes
  • intellectual property disputes
  • defamation

The hard benefits of mediation, when weighed against going to court, include costs savings and a speedier outcome, yet it also provides “soft” benefits such as a safe and supportive environment, confidentiality (courts are potentially public), and may preserve relationships that an adversarial court battle could destroy.
